According to German law, the creation of a work automatically creates a copyright.  A copyright notice is not required.  How a work is protected by copyright is defined by the law.  The person who violates the copyright can be given a warning for this offense.  In this case, the warning fee in at least a three-digit amount and legal fees are usually due, as well as the signing of a cease and desist declaration.  The economic damage incurred can also be sued.
